General Terms and Conditions
1. Scope of application
These General Terms and Conditions apply to all shipments from Opus Abscondi to consumers (§ 13 BGB).
A consumer is any natural person who enters into a legal transaction for a purpose that is outside his trade, business or profession.
2. Contract partners

3. Offer and Conclusion of Contract
3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place a purchase order. Errors excepted.
3.2 By clicking the button [zahlungspflichtig bestellen], you place a binding purchase order regarding the products listed on the order page. The sales contract is concluded if we accept your purchase order by means of an order confirmation by e-mail immediately upon receiving your purchase order.
4. Right of revocation
4.1 Consumers have the following right of revocation.

You may cancel your contractual statement, without stating any reasons, in writing (e.g. letter, fax, email) within two weeks or - if the item has been sent to you prior to the date of expiry - by returning the goods. The revocation period shall start upon receipt of this notification in writing, however not before the receipt of the goods by the recipient (for the recurring delivery of similar goods not before the receipt of the first partial delivery) and not before the information obligations according to article 246 section 2 in connection with section 1 nos. 1 and 2 EGBGB (Germany Introductory Act to the Civil Code) as well as our obligations according to section 312g para 1 no. 1 BGB (German Civil Code) in connection with article 246 section 3 EGBGB are fulfilled. The revocation period shall be deemed observed if the items are returned or notice of revocation is given within this period.

Consequences of revocation
In the case of an effective revocation, each party shall return the services received and any drawn capitalised use (e.g. interest), if any, shall be returned. If you are unable to return the services received or reimburse the capitalised use (e.g. benefit of use), in whole or in part, or only in a deteriorated condition, you shall compensate for the lost value where applicable. You only have to compensate for the deterioration of the item or the benefits enjoyed if the benefits or deteriorations are due to a handling of the item exceeding the verification of the features and the functioning. "Verification of the features and the functioning" means that the respective item is tried and tested as would be possible and usual in a retail store. Items that can be shipped by parcel shall be returned at our risk. You have to bear the regular costs of the return if the delivered item corresponds to the one ordered and if the price of the item to be returned does not exceed an amount of EUR 40 or if, in case of a higher price of the item, the service has not yet been rendered or the contractually agreed partial payment has not yet been effected at the time of the revocation. Otherwise the return is free of charge for you. Items that cannot be shipped by parcel shall be picked up from you. Items that cannot be shipped by parcel shall be picked up from you.
Obligations to refund payments have to be fulfilled within 30 days. For you the period starts with sending your declaration of revocation or the item, for us upon its receipt.

The right of revocation does not apply in case of distance selling contracts concerning the shipment of audio and video recordings or of software if the shipped data carriers have been unsealed by the consumer.
4a. Return charges when excercising the right of revocation
If you make use of your right of revocation, you will bear the regular costs of the return if the delivered item corresponds to the one ordered and if the price of the item to be returned does not exceed an amount of EUR 40 or if, in case of a higher price of the item, the service has not yet been rendered or the contractually agreed partial payment has not yet been effected at the time of the revocation. Otherwise the return is free of charge for you.
5. Prices and shipping costs
5.1 The prices indicated on the product pages include the German statutory value added tax and additional price components..

6. Shipment
6.1 Shipments within the EU and international shipments are done by DHL. Vinyl records within Germany are shipped via Hermes.
6.2 Delivery times can vary according to the country of destination. The door-to-door time can be checked by a DHL internet service. Opus Abscondi ships the goods immediately, at the latest within approximately three working days.
7. Payment
Paypal or advance payment are the only payment methods.
8. Warranty
We extend implied warranty to all products in this shop.
9. International clause
These General Terms and Conditions are according to German Law, which offers comprehensive consumer protection. However, compulsory consumer protection standards of other countries to which Opus Abscondi could ship should not be excluded by this choice of jurisdiction.

You can remove the products at any time from your shopping cart by clicking on the button [delete]. If you wish to purchase the products in your shopping cart, click the button [proceed to checkout]. Then, please enter your data. Mandatory information is marked with an *. Registration is not required. Your data is encrypted before transfer. After you have entered your data and selected the method of payment you can click on the [Check details] button to reach the order page, where you can see the entries you have made and check them again. If you have created a customer account, you can view your customer data at any time via ‘Customer login’. You will receive the purchase order details by e-mail. For security reasons, the text of the contract is no longer accessible via the Internet after the purchase order is finished.
